The Online Services are provided solely for personal, non-commercial use. DermPro does not provide medical diagnosis, clinical treatment, emergency care, or personalised healthcare advice. The Services are not a substitute for consultation with a qualified medical practitioner.
We may update these Terms at any time to reflect changes in the law, technology, or business practices. Where changes are material, we will provide notice within the app or website. Your continued use of the Services after any update constitutes acceptance of the revised Terms.
2. Scope of Services
DermPro provides users with access to:

DermPro does not:
- Provide a medical diagnosis
- Provide treatment, prescriptions, or referrals
- Offer emergency or urgent care services
- Replace advice from a qualified healthcare professional
All outputs are informational only.
3. Medical Disclaimer
DermPro is not a medical device and does not perform diagnostic or therapeutic functions. Any risk indication generated by the app is based on automated analysis of user-submitted images and is subject to technical limitations, environmental factors, and image quality.
The Services must not be used as a sole basis for:
- Medical decisions
- Delaying treatment
- Self-diagnosis
If you have concerns about a skin lesion, including changes in size, shape, colour, pain, bleeding, or irritation, you must seek immediate advice from a qualified healthcare professional.
4. Eligibility and Account Registration
To use DermPro, you must be at least 18 years of age and capable of entering into a legally binding agreement. You agree to provide accurate, current, and complete information during registration and to update your information as necessary.
You are solely responsible for safeguarding your account credentials and for all actions performed using your account. DermPro is not responsible for unauthorised access resulting from your failure to protect your account information.
5. User Responsibilities
You agree to use the DermPro Services only for lawful and personal purposes and in accordance with these Terms. You must not use the Services to engage in any unlawful, fraudulent, or unethical activity, or to attempt to gain unauthorised access to any part of the system.
You are responsible for ensuring that any images or content you upload are your own or that you have full rights and permission to submit them. You must not submit content that is false, misleading, harmful, offensive, defamatory, or otherwise inappropriate.
You agree not to attempt to reverse engineer, reproduce, modify, or misuse the technology, software, or algorithms underlying the Services. You must seek professional medical advice for any skin health concerns and understand that DermPro is not a substitute for consultation with a qualified healthcare professional.
You acknowledge that you must not use the Services to make clinical or diagnostic claims about yourself or any other person. Any violation of these responsibilities may result in suspension or termination of your account, without refund, at DermPro's discretion.
6. Image Uploads & Consent
By submitting images to DermPro, you confirm that you are the lawful owner of the images or otherwise have full rights to upload and use them in connection with the Services.
You grant DermPro a non-exclusive, worldwide, royalty-free, revocable licence to store, process, and analyse the images for the purpose of providing the Services, monitoring skin health trends, improving algorithms, and performing quality control and system optimisation. You also consent to the automated analysis of these images and understand that the results are probabilistic indicators and not medical diagnoses.
DermPro may use anonymised or de-identified image data for research purposes, analytics, and system enhancements in accordance with the Privacy Act 1988 (Cth) and Australian Privacy Principles. DermPro takes all reasonable steps to secure and protect user data and images, but you acknowledge that no system can be guaranteed fully secure.
7. When Not to Use the Assessment
DermPro's AI-assisted assessment tools are designed for specific types of skin images. You should not use the app to assess lesions that are bleeding, open, infected, or otherwise compromised, as this may yield unreliable results. The service is also not intended for lesions located under nails, on mucosal surfaces, on heavily tattooed areas, or on areas obstructed by hair, shadows, or other objects. Similarly, images of very dark skin where contrast between the lesion and surrounding skin is insufficient may lead to inaccurate indications.
Using the Services in any of these circumstances may produce misleading or inconclusive outputs. If you are unsure about a lesion or notice changes such as bleeding, irritation, rapid growth, or colour change, you must consult a qualified healthcare professional promptly.
8. Data Collection & Privacy
DermPro collects personal information, including but not limited to your name, contact details, account credentials, and uploaded images, to provide, maintain, and improve the Services, communicate with users, comply with legal obligations, and ensure safety.
We adhere to the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Personal data is used strictly in accordance with our Privacy Policy, which outlines the types of information collected, how it is stored and processed, and your rights in relation to your data.
DermPro takes reasonable steps to safeguard your personal and sensitive information, including implementing appropriate technical and organisational measures to protect against unauthorised access, modification, disclosure, or destruction. By using the Services, you consent to the collection, use, and storage of your personal data as described in our Privacy Policy.
9. Fees & Payments (if applicable)
Certain features of the DermPro Services may require payment. All applicable fees will be clearly disclosed to you prior to purchase. Payments are processed securely via reputable third-party payment providers and are subject to their terms and conditions.
You authorise DermPro to charge your chosen payment method for any applicable fees. Any subscriptions, credits, or other paid features may be non-refundable, except where required by law, including under the Australian Consumer Law.
Nothing in these terms is intended to limit, remove, or alter your statutory rights under applicable consumer protection legislation.
10. No Warranties
To the fullest extent permitted by Australian law, DermPro provides the Online Services on an "as is" and "as available" basis. While DermPro makes reasonable efforts to ensure the functionality, reliability, and accuracy of the Services, we do not guarantee that the App, Website, or any content will be uninterrupted, error-free, secure, free from viruses, or suitable for any particular purpose.
We make no express or implied warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. Any reliance you place on the Services is strictly at your own risk.
You acknowledge that technological systems may fail or produce errors and that risk indications are probabilistic and not definitive medical conclusions.
11. Disclaimer, Limitations and Exclusions of Liability
To the maximum extent permitted by law, DermPro, its directors, employees, affiliates, and contractors shall not be liable for any loss, damage, cost, expense, or injury arising out of or in connection with your use of, or inability to use, the Online Services.
This includes, without limitation, loss or damage arising from reliance on any content, risk indication, system malfunction, data loss, service interruption, or third-party interference. DermPro shall not be responsible for any clinical, medical, or personal decisions made by you based on information obtained through the Services.
Nothing in these terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies conferred by the Australian Consumer Law that cannot lawfully be excluded. Where liability cannot be excluded, DermPro's liability is limited, at its option, to resupplying the Services or paying the cost of having the Services supplied again.
DermPro shall not be liable for any indirect, incidental, special, or consequential loss, including loss of business, profits, data, reputation, or anticipated savings, even if such loss was foreseeable. DermPro is not liable for any delay or failure resulting from events beyond its reasonable control, including acts of God, natural disasters, cyber incidents, power failures, or governmental actions.
12. Intellectual Property and Licence
All content, software, algorithms, designs, text, images, logos, trademarks, and other intellectual property associated with DermPro are owned by or licensed to DermPro and are protected under Australian and international intellectual property laws.
DermPro grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services solely for your personal, non-commercial use in accordance with these Terms. You must not copy, reproduce, modify, distribute, reverse engineer, decompile, create derivative works, or commercially exploit any part of the Services without DermPro's prior written consent.
Nothing in these terms transfers ownership of any intellectual property to you.
13. Suspension, Termination and Discontinuation
DermPro may, at its sole discretion, suspend, restrict, or terminate your access to the Services at any time, with or without notice, if you breach these Terms, misuse the Services, act unlawfully, or engage in conduct that may harm DermPro, its users, or third parties.
DermPro also reserves the right to modify, suspend, or permanently discontinue the Services, or any part thereof, at any time.
You may stop using the Services at any time by deleting your account. Upon termination, all rights granted to you under these Terms immediately cease. Any provisions that by their nature should survive termination, including limitation of liability, intellectual property, and governing law, will remain in effect.
14. Governing Law, Jurisdiction and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of New South Wales for any dispute arising out of or in connection with these Terms or the Services.
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will continue in full force and effect. These Terms constitute the entire agreement between you and DermPro relating to the use of the Services and supersede all prior understandings or agreements.
